Center Files Amicus Brief in RFRA Case

Case Description

The Center filed an amicus brief in the U.S. Court of Appeals for the Ninth Circuit seeking en banc reconsideration in Apache Stronghold v. USA. The brief, drafted pro bono by the Harvard Law School Religious Freedom Clinic, asks all the judges in the largest federal circuit court to rehear this important religious freedom case in which the lower court misapplied and gutted the Religious Freedom Restoration Act by holding that destruction of a site sacred to the Western Apache Indians does not substantially burden their religion despite the government’s admission that the mining of the sacred Oat Flat site will destroy it forever.
