Case Description
The Texas Supreme Court issued an opinion in a case in which the Center filed an amicus brief last fall. The case, Hensley v. State Commission on Judicial Conduct, was brought by a local judge who politely declined to officiate same-sex weddings (a discretionary function, not an official duty) but then was publicly disciplined by the state judicial commission. The state supreme court held that the lower court must consider the judge’s defense under Texas’ Religious Freedom Restoration Act (a bill the Center was active in lobbying for in 1999).
