Brief Filed to Support Native American RFRA Case

Case Description

The Center filed an amicus brief in the U.S. Supreme Court in support of Native Americans whose sacred mountain the federal government plans to obliterate by mining without the necessary consideration of their free exercise of religion rights. The brief, drafted pro bono by the Religious Liberty Clinic at Stanford Law School, asks the Court to hear this important religious freedom case in which the lower court misapplied and gutted the Religious Freedom Restoration Act by holding that destruction of a site sacred to the Western Apache Indians does not substantially burden their religion despite the government’s admission that the mining of the sacred Oat Flat site will destroy it forever.
